Kerala High Court Grants MLA Interim Protection in Rape Case
Kochi, Kerala – December 6, 2025 – The Kerala High Court today provided interim protection from arrest to expelled Congress MLA Rahul Mamkootathil, who is accused of rape and forced abortion. Justice K. Babu ordered that Mr. Mamkootathil cannot be arrested until his anticipatory bail plea is heard on December 15th.
The order comes after a sessions court in Thiruvananthapuram rejected Mr. Mamkootathil’s anticipatory bail plea in the first case, which was registered last week. In addition to the first case, a second rape allegation has surfaced from a woman residing in Bengaluru.
Mr. Mamkootathil, who has reportedly been absconding since the initial allegations, claims innocence and argues that custodial interrogation is unnecessary. In his plea to the High Court, he alleges that his relationship with the first complainant was consensual and that she is attempting to discredit him now that their relationship has soured. He also claims that the woman, who is allegedly separated from her husband, is trying to “save her own skin.”
The MLA further claims that the investigation agency is misrepresenting the facts and asserts that he has evidence to support his claims. He has stated he is willing to cooperate with the investigation if granted the opportunity to appear before the investigating officer without fear of arrest. The case continues.
