Bombay High Court Denies Mosque Loudspeaker Plea, Cites Noise Pollution Concerns
Nagpur, December 5, 2025 – The Nagpur Bench of the Bombay High Court has denied a petition from a mosque in Gondia district seeking permission to use loudspeakers for prayer, citing concerns over noise pollution and the absence of religious mandates requiring such amplification.
In a ruling delivered on December 1st, Justices Anil Pansare and Raj Wakode stated that the Masjid Gousiya had failed to demonstrate that using loudspeakers was a necessary or mandatory aspect of their religious practice. The court referenced Supreme Court judgments emphasizing that no religion dictates prayers be conducted through voice amplifiers or drums.
The Bench further underscored the rights of citizens to enjoy reasonable quiet, particularly vulnerable populations like children, the elderly, and those with mental health conditions. They declared that the mosque was not entitled to the relief it sought as a matter of right and dismissed the petition.
Taking suo motu cognisance of the widespread issue of noise pollution, the court urged the Maharashtra government to develop an effective solution. They highlighted the severe health impacts of excessive noise, including cardiovascular disease, anxiety, hearing damage, and mental illness, potentially leading to eardrum rupture at levels exceeding 120 decibels.
The court also pointed to noise pollution violations occurring at event halls in Civil Lines and religious places using loudspeakers for “bhajans.” They expressed hope that the State government would address the issue and prioritize public health.
