The Vedhi, an organization dedicated to reclaiming “alienated Waqf holdings,” argues that the High Court’s Division Bench overstepped its authority by ruling on the validity of the Waqf declaration, a matter solely under the jurisdiction of the Waqf Tribunal. The challenged order stemmed from a writ petition filed by the Kerala State government related to an inquiry commission into the Munambam issue.
The Vedhi contends the High Court bypassed proper legal procedures by making a declaration on the property while the matter was actively being considered by the Waqf Tribunal. They further emphasized that the Waqf status of the Munambam property was not even the primary subject of the High Court proceedings.
The Kerala Waqf Board itself has filed a review petition with the Division Bench, similarly claiming that the court exceeded its judicial mandate by ruling on an issue not directly raised by any party involved.
The Vedhi argues that the High Court’s decision prejudices the ongoing proceedings before the Waqf Tribunal, potentially rendering its statutory adjudication meaningless and infringing upon the rights of both the Vedhi and the Waqf Board. They also criticize the High Court’s endorsement of the government’s involvement in a matter already before the tribunal. The Supreme Court will now consider whether to take up the case, potentially setting a significant precedent for Waqf property disputes in Kerala.
