New Delhi: Vodafone Idea (Vi), the struggling telecom operator, received a significant boost on Monday after the Supreme Court clarified that the government can reassess and reconsider its adjusted gross revenue (AGR) dues up to fiscal year 2017. This includes a reassessment of interest and penalties, potentially offering substantial financial relief to the company burdened by massive debt.
The clarification stemmed from a previous Supreme Court order restricting relief on additional AGR dues up to FY17. Vi, in its petition, sought a comprehensive reassessment of all AGR dues for the period, arguing that the hefty liabilities threatened its survival and the livelihoods of its employees. The company currently owes approximately ₹83,400 crore in AGR dues, with overall liabilities, including penalties and interest, estimated at ₹2 trillion.
AGR, a key component in calculating license fees and spectrum charges for telecom companies, has been a contentious issue. The Department of Telecommunications (DoT) had raised an additional demand of around ₹5,606 crore from Vi for the period up to FY17, but the reassessment now opens the door for a review of the entire AGR debt.
“The telco requested the Supreme Court to ask the government to reassess and reconsider all AGR dues up to FY17, including interest and penalties,” said Mahesh Agarwal, Vodafone Idea’s advocate in Supreme Court.
The Supreme Court bench, led by Chief Justice B.R. Gavai and Justice K. Vinod Chandran, observed that Vi’s petition was restricted to the additional AGR demand raised by the DoT for the period up to FY17. However, the clarification now extends the scope of the reassessment.
News of the Supreme Court’s clarification sent Vi shares soaring, with a surge of over 9% on the National Stock Exchange on Monday.
The struggling telecom giant, in which the government holds a 49% stake, has previously stated that its cash flows are insufficient to meet the AGR dues. Former CEO Akshaya Moondra had emphasized that an early resolution of the AGR dispute was crucial for the company to secure funding from banks.
With approximately 198 million subscribers and over 18,000 employees, the fate of Vodafone Idea is seen as crucial for the Indian telecom sector. The Supreme Court’s decision offers a glimmer of hope, potentially paving the way for financial stability and continued operations for the beleaguered company. The written order is still awaited.
