Christmas Spirit Arrives Early as Workers Ask: When Will the 13th Salary Be Paid?

Rio de Janeiro, Brazil – October 21, 2025 – With panetones, French toast, and Christmas decorations already lining shelves nationwide, the holiday season is officially underway. This annual festive atmosphere brings with it the perennial question among Brazilian workers: when will the “décimo terceiro salário” (13th salary) be paid?

The “EXTRA” has compiled key information to help workers plan their holiday spending. This mandatory bonus, often split into two installments, has a first payment deadline of November 30th. However, employers can begin payments as early as February, often coinciding with employee vacations or birthdays. Workers are advised to confirm if they have already received their first installment to avoid confusion.

All formally employed workers (those with a “carteira assinada”) who have worked for 15 days or more during the year, as well as retirees and pensioners, are entitled to the 13th salary. The National Social Security Institute (INSS) has already disbursed the first installment to its beneficiaries.

Employment lawyers Juliana Campão Pires Fernandes Roque (Lopes Muniz Advogados) and Silvana Campos shared crucial details:

  • Payment Deadlines: The first installment is due by November 30th, and the second by December 20th.
  • Payment Amounts: The first installment is 50% of the total 13th salary, paid gross (without deductions). The second installment includes deductions for INSS and income tax.
  • Late Payments: Employers are legally obligated to pay the 13th salary on time. If a worker does not receive their salary by December 20th, they can pursue legal action in labor court or request indirect termination of their contract due to the employer’s non-compliance.
  • Resigned/Terminated Employees: Workers who left their jobs during the year receive a proportional 13th salary based on months worked (15 days or more in a month counts as a full month). This payment is made in a single installment as part of their severance package.
  • Full Payment Deadline: The full 13th salary payment must be made by December 20th.
