**Washington D.C. -** The Trump administration has appealed to the Supreme Court in a bid to overturn a federal appeals court ruling that deemed many of the former president’s tariffs illegal. The move comes amidst escalating trade and geopolitical tensions, particularly with India over its continued purchase of Russian energy.
In court documents filed this week, the administration argues that the tariffs are a critical tool for achieving peace in Ukraine. They specifically cite the recent authorization of tariffs against India for purchasing Russian energy products, implemented under the International Emergency Economic Powers Act (IEEPA) due to a pre-existing national emergency related to the war in Ukraine.
The administration doubled tariffs on India to 50 percent on August 27, with half intended to penalize New Delhi for increased Russian oil imports following the invasion of Ukraine and the other half intended to promote the former president’s “America First” policy aimed at reducing trade deficits.
The filing paints a dire economic picture without tariffs, claiming that with them, the US is a rich nation and without, it is a poor nation.
The legal challenge follows a ruling by the US Court of Appeals for the Federal Circuit last week, which found that Trump exceeded his authority by using emergency economic powers to impose widespread duties. The court granted the administration until mid-October to appeal to the Supreme Court.
The former President lashed out at the appeals court decision on social media, vowing to fight back with the assistance of the Supreme Court and claiming the US will ultimately win.
Treasury Secretary Scott Bessent had stated that removing the tariffs would lead to a diplomatic embarrassment.
