**Melbourne, May 13, 2025** – The International Civil Aviation Organisation (ICAO) Council has officially declared Russia responsible for the downing of Malaysia Airlines Flight 17 over Ukraine in 2014, a tragedy that claimed 298 lives. This landmark ruling, following a decade of investigation and legal maneuvering, opens the door for victims’ families to seek compensation.

A 2016 Dutch-led investigation had already concluded that a Russian-supplied Buk missile system, launched from separatist-held Ukrainian territory, brought down the Amsterdam-to-Kuala Lumpur flight. Russia has consistently denied any involvement.

The Netherlands and Australia, representing many of the victims, brought the case before the ICAO in 2022, bypassing the International Court of Justice due to Russia’s refusal to recognize its jurisdiction. The ICAO Council’s decision marks the first time the organization has ruled on a dispute between governments.

The Council found Russia violated the Chicago Convention, which prohibits the use of weapons against civilian aircraft. Dutch Foreign Minister Caspar Veldkamp stated the Council will consider reparations within weeks, with the Netherlands and Australia requesting negotiations facilitated by the ICAO to ensure good faith and timely results. Australian Foreign Minister Penny Wong echoed this sentiment, urging swift action and calling on Russia to accept responsibility and provide reparations.

While the ICAO Council’s full reasoning is yet to be published, international law expert Don Rothwell anticipates recommendations for Russia to pay damages. The Russian Embassy in Australia has yet to respond to requests for comment. The ruling marks a significant step towards justice for the victims of this devastating tragedy.
