**New Delhi, [Date]** – The Supreme Court of India has overturned lower court decisions and ordered that murder charges be filed against a family accused of an honor killing in Uttar Pradesh. The court expressed strong disapproval of the initial charge of culpable homicide not amounting to murder, deeming it insufficient for the brutal nature of the crime.
The case involves the death of 26-year-old Zia-ur Rahman, who was allegedly beaten to death with iron rods and wooden sticks by members of his partner’s family. The lower courts had cited the absence of firearms and insufficient evidence of intent to kill as reasons for not charging the accused under Section 302 of the Indian Penal Code (IPC), which pertains to murder.
Chief Justice Sanjiv Khanna, however, sharply criticized this reasoning, stating that the case was a clear instance of honor killing and that the numerous injuries sustained by Rahman indicated a clear intent to kill. The court noted the presence of 10 ante-mortem injuries.
The Supreme Court has directed the Uttar Pradesh chief secretary to appoint a special public prosecutor, with the consent of the victim’s father, Ayyub Ali, to handle the case in a Saharanpur court. The accused family members, previously charged with culpable homicide, will need to seek fresh bail considering the upgraded charges. They will not be arrested until their bail applications are decided.
This decision comes after the Allahabad High Court rejected Mr. Ali’s appeal in August 2024, upholding the lower court’s decision. Mr. Ali had originally challenged the February 27, 2024, order of the additional district judge, which refused to file murder charges against Janeshar, Maneshar, Priyanshu, and Shivam. The Supreme Court’s intervention marks a significant development in this high-profile honor killing case.
