**Washington D.C.** – In a unanimous 9-0 decision, the Supreme Court ruled Thursday that the Trump administration must facilitate the return of Kilmar Abrego Garcia, a Maryland man mistakenly deported to El Salvador’s notorious Cecot prison. The Court rejected the administration’s appeal of a lower court order demanding Garcia’s repatriation.

Garcia, a Salvadorian migrant, was among dozens deported to Cecot, a facility known for housing gang members, as part of a US-El Salvador agreement. His deportation, which occurred on March 15th despite a court order preventing it, was acknowledged by the administration as an administrative error. However, the government argued in its appeal that it lacked the authority to compel El Salvador to return Garcia and that the lower court judge overstepped her bounds.

The Supreme Court, while ordering Garcia’s return, also instructed the district judge to clarify her order, emphasizing the executive branch’s authority in foreign affairs. The Court’s decision did not set a deadline for Garcia’s return.

“The rule of law prevailed,” stated Simon Sandoval-Moshenberg, Garcia’s lawyer, following the ruling. The Justice Department, while acknowledging the Court’s decision, maintained that the President holds the sole prerogative in conducting foreign affairs.

Garcia, who entered the US illegally as a teenager and was granted protection from deportation in 2019, is married to a US citizen. His wife, Jennifer Vasquez Sura, has been advocating tirelessly for his return, expressing relief but continued concern for her family. The case now returns to the district court. The administration maintains its claim that Garcia is a member of the MS-13 gang, a claim his lawyer denies.
