**Washington, D.C.** – Chief Justice John Roberts Jr. has temporarily blocked a lower court order demanding the United States return a Salvadoran migrant, Kilmar Armando Abrego Garcia, who was inadvertently deported last month. The Chief Justice issued an “administrative stay” on Monday, giving the Supreme Court time to consider the matter before a deadline of 11:59 p.m. that same day.
The order comes after the U.S. government urgently appealed to the Supreme Court, arguing that a Maryland federal judge, Paula Xinis, overstepped her authority. Judge Xinis had ruled that the administration’s deportation of Garcia to a notorious El Salvadoran prison constituted a “grievous error” and ordered his return.
The government, represented by Solicitor General D. John Sauer, contended that Judge Xinis’s order amounted to “district-court diplomacy,” requiring the U.S. to negotiate with El Salvador for Garcia’s release. Sauer warned that upholding the lower court’s decision would set a dangerous precedent, granting district courts extraterritorial jurisdiction over U.S. foreign relations.
The Supreme Court is expected to issue a final ruling in the coming days.
