**Kochi, April 6, 2025** – The Kerala High Court ruled today that a convict’s plea for premature release cannot be automatically rejected solely based on the conviction being for the murder of a woman. The court overturned the State Level Committee’s rejection of a premature release plea for Balu, convicted of murdering a woman.

The High Court cited a Supreme Court precedent, stating that blanket exclusions of certain offenses from remission consideration are arbitrary and contradict the principles of reformation central to the criminal justice system. The court emphasized that a blanket policy denying remission to all those convicted of murdering women is incompatible with a welfare state.

The decision highlights the importance of considering individual circumstances. Despite the nature of the crime, the court noted that police, probation officers, the prison superintendent, and the Jail Advisory Committee all recommended Balu’s premature release. These recommendations, related to the concept of reformation, cannot be disregarded simply because of the type of crime committed, the court ruled.
