Mon Mar 24 13:10:35 UTC 2025: ## Top Lawyer Calls for Forensic Probe into Judge’s Cash-at-Home Scandal, Reforms to Judicial Discipline

**NEW DELHI** – Prominent Indian lawyer Mukul Rohatgi has demanded a full forensic investigation into the case of Delhi High Court Judge Yashwant Varma, whose home was the scene of a cash-burning incident on Holi. Rohatgi, a former Attorney General of India, criticized the Supreme Court’s decision to order an internal investigation, calling for a police investigation and the analysis of all available evidence, including CCTV footage. He highlighted the inadequacy of the current impeachment process for judicial misconduct, stating that its complexity has prevented any successful impeachment in India’s 75-year history.

The incident, involving partially burnt currency notes found at Justice Varma’s residence, has sparked widespread concern. Rohatgi argued that if the judge is found guilty, swift action is necessary, and the current system is insufficient. He advocated for a more streamlined disciplinary process for judges, suggesting a reform of the collegium system responsible for judicial appointments. He described the collegium as “absolutely unsatisfactory and opaque,” calling for increased transparency and the inclusion of non-judicial members in the selection process.

The Supreme Court’s decision to transfer Justice Varma back to the Allahabad High Court, his previous posting, has also drawn criticism. Rohatgi questioned the court’s assertion that the transfer is unrelated to the cash-at-home incident, suggesting the two are inextricably linked. He emphasized the need to determine whether the judge is guilty of misconduct and whether his reputation has been unfairly tarnished.

Former Solicitor General Harish Salve echoed these concerns, stating that any transfer should be suspended pending a thorough investigation. He argued that if the allegations are false, the transfer is unfair, and if true, the transfer is an insufficient response. The controversy highlights ongoing debates surrounding judicial accountability and transparency in India’s legal system.
