**New Delhi** – Former Attorney General of India, Mukul Rohatgi, has demanded a thorough investigation into allegations of a cash stash found at the Delhi High Court residence of Justice Yashwant Varma. In an interview with NDTV, Rohatgi expressed skepticism about the Supreme Court’s assertion that Justice Varma’s transfer to the Allahabad High Court is unrelated to the ongoing inquiry.
Rohatgi questioned the Supreme Court’s statement, stating, “I have never understood the statement that this transfer proposal has nothing to do with the cash scam.” He argued that the transfer, while seemingly inconsequential given Justice Varma’s current lack of judicial work, overshadows the critical need for a conclusive investigation into the allegations of misconduct. He emphasized the need to determine whether the judge acted improperly and whether his reputation has been unjustly tarnished.
Rohatgi further criticized the apparent lack of a robust police investigation into the cash, noting the destruction of potential evidence and the absence of a thorough forensic examination. He contrasted the apparent inaction in this case with the standard procedure followed in similar instances involving non-judicial personnel. He stressed the need for a comprehensive investigation, including the analysis of call detail records (CDRs) and CCTV footage, involving various agencies such as the police, fire department, and CRPF.
While acknowledging the unique position and potential vulnerability of judges to unfounded accusations, Rohatgi reiterated that no one is above the law. He highlighted the existing, cumbersome impeachment process as a significant obstacle to accountability within the judiciary and advocated for reforms to streamline disciplinary procedures. He praised the Supreme Court’s increased transparency in this matter but emphasized the need for significant improvements in transparency and accountability within the judicial system, particularly regarding the appointment and disciplinary processes of judges.
Rohatgi also commented on the protests by Allahabad High Court lawyers against Justice Varma’s transfer, urging caution and a wait for the results of the investigation before reaching conclusions.
