CHENNAI, March 8, 2025 – The Madras High Court has ordered the Indian Bank to grant a monthly pension to a former employee discharged for embezzling ₹5.75 lakh. The court’s decision was significantly influenced by the employee’s wife, who played a crucial role in uncovering and rectifying the fraud.

Justice D. Bharatha Chakravarthy lauded the wife’s actions, describing her conduct as “exemplary” and instrumental in the court’s decision. The court heard that in 2002, while working at the Egmore branch, J. James (name changed) was suspected of embezzling funds. Initially denying involvement, he confessed after his wife’s intervention and persuasion. She subsequently helped him raise the money to repay the bank in full.

While the bank dismissed James in 2004, a Labour Court later reduced the punishment to discharge. James then petitioned the High Court, arguing his confession was coerced. Justice Chakravarthy upheld the discharge but, impressed by the wife’s actions, ordered the bank to pay James both his gratuity and a monthly pension, including arrears, within 12 weeks. Failure to comply will result in a 9% annual interest penalty. The judge specifically commended the wife’s “righteousness” in guiding her husband back to the “right path.”
