**NEW DELHI, February 20, 2025** – The Supreme Court of India has overturned four directives issued by the Madras High Court concerning the Formula 4 racing event held in Chennai. The High Court had ordered Racing Promotion Private Ltd (RPPL), the private company organizing the event, to reimburse ₹42 crore to the Tamil Nadu government and to pre-deposit funds for future events. The High Court also ruled that RPPL should bear all event expenses, limiting the state’s role to facilitation.
The Supreme Court, however, upheld the validity of the public-private partnership (PPP) between RPPL and the Tamil Nadu Sports Development Authority (SDAT). In a judgment authored by Justice P.S. Narasimha, the court stated that PPPs are a globally accepted practice for efficient and effective governance, especially when considering limited state resources. The court found no evidence of misappropriation of funds or malfeasance.
Justice Narasimha noted that the government’s shift towards PPPs reflects a recognition of the potential for private enterprise to deliver public services more effectively than direct government provision. The court emphasized that the SDAT, as a state instrumentality, is not distributing “largesse,” and the judicial review of such contractual arrangements is limited in scope. The Supreme Court ruled that the High Court’s directives were not legally sustainable. The Formula 4 event was conducted under a three-year Memorandum of Understanding (MoU) signed in August 2023.
