**NEW DELHI, February 19, 2025** – The Delhi High Court has issued a landmark ruling advocating a more compassionate approach to cases involving adolescent relationships, prioritizing understanding over punishment. The court’s decision came during the adjudication of a sexual assault case registered under the Protection of Children from Sexual Offences (POCSO) Act. While upholding a lower court’s acquittal of a man accused by the father of a 16-year-old girl, the High Court emphasized the girl’s assertion that the relationship was consensual.

Justice Jasmeet Singh stated that although the POCSO Act aims to protect children, it doesn’t differentiate between minors who choose partners willingly. While acknowledging that any sexual act with a minor under 18 is technically an offense under the Act, the judge stressed the need for a legal system that acknowledges the rights of young people to love and form relationships, provided they are consensual and free from coercion.

Justice Singh argued that the focus should shift from punishing adolescent love to preventing exploitation and abuse. He called for a societal and legal shift towards recognizing the fundamental human experience of love among adolescents and respecting their right to emotional connections. The judge emphasized the importance of the legal age of consent in protecting minors but suggested that adolescents should not fear criminalization for consensual relationships. The ruling highlights a growing debate on balancing the protection of minors with the recognition of adolescent autonomy.
