**Toronto, ON** – A Canadian father is suing a Dominican Republic resort and its travel partners for $10 million following the death of his wife and eight-year-old son from suspected food poisoning. Stephen Gougeon filed the lawsuit in Ontario Superior Court on Monday, alleging negligence by Wyndham Hotels and Resorts and Air Transat.
Gougeon’s family travelled to the Viva Dominicus Beach by Wyndham Resort in December 2023. After a buffet dinner, all four family members – Stephen, his wife April (41), their eight-year-old son Oliver, and seven-year-old son Wesley – became violently ill. Gougeon claims their initial requests for medical assistance were ignored by the resort, with help only arriving after their condition worsened significantly.
The family was eventually transported to a local hospital, where April and Oliver succumbed to complications stemming from suspected food poisoning. Gougeon alleges delays in receiving medical attention contributed to their deaths.
The lawsuit claims the resort failed to maintain adequate hygiene standards, implement proper emergency procedures, and respond promptly to the family’s medical needs. Gougeon states that the resort’s delayed and confused response cost precious time that could have saved his wife and son. The $10 million claim seeks compensation for the loss of life and the emotional distress suffered by Gougeon and his surviving son. Wyndham Hotels and Resorts and Air Transat have yet to publicly comment on the lawsuit.
