**New Delhi, January 28, 2025** – The Supreme Court is considering a request to grant custody parole to Tahir Hussain, an AIMIM candidate accused in the 2020 Delhi riots, to allow him to campaign in the upcoming Delhi Assembly elections. A three-judge bench has given Delhi Police until 2 PM on January 29th to respond to the suggestion.

The request follows a split verdict by a two-judge bench on January 21st. One judge argued that campaigning isn’t a fundamental right and granting bail to Hussain would set a precedent. The other judge emphasized Hussain’s prolonged pre-trial detention (since March 2020) as grounds for interim bail.

The Supreme Court is weighing the security implications and associated costs of Hussain’s temporary release. The court suggested the costs could be paid in advance by Hussain’s representatives. Justice Vikram Nath noted that the electorate might even sympathize with Hussain’s situation if he remains in custody. The court clarified that this would be a limited, supervised parole, ending on February 4th. The Delhi Police will present their response considering the potential for setting a precedent by granting such a request.
