Mon Jan 27 16:56:10 UTC 2025: **Madras High Court Orders Removal of All Political Party Flagpoles from Public Places in Tamil Nadu**
Madurai, Tamil Nadu – January 27, 2025 – The Madurai Bench of the Madras High Court issued a sweeping order today mandating the removal of all permanently erected flagpoles belonging to political parties and organizations from public spaces across Tamil Nadu within 12 weeks. The court cited concerns over encroachment, public inconvenience, and law and order issues stemming from these flagpoles.
Justice G.K. Ilanthiraiyan’s directive affects flagpoles on national and state highways, municipal lands, and other government property. Authorities are instructed to remove any flagpoles not removed within the 12-week deadline, after issuing a two-week notice. The costs of removal will be recovered from the responsible parties.
The court explicitly forbade the future granting of permission for permanent flagpoles on public land. While temporary erection during events may be permitted on a rental basis, strict regulations will be implemented to ensure the restoration of the public space to its original condition afterward. The state government has been tasked with creating rules for flagpole erection on private land.
The ruling comes in response to numerous petitions and cites over 114 pending FIRs related to the illegal erection of political flagpoles. The court highlighted the inconvenience caused to the public, including road blockages during celebrations and elections, and emphasized that public spaces such as pavements and street corners are meant for public use. The court also ruled that authorities lacked the jurisdiction to grant permission for permanent flagpole installations in the first place.
