**NEW DELHI** – A Delhi court has suspended a lookout circular (LOC) preventing Siddhant Gupta, former promoter of Kwality Ltd., from leaving the country. The LOC, issued by the Enforcement Directorate (ED) as part of a money laundering investigation, was temporarily lifted to allow Gupta to travel to Singapore to assist his daughter with her studies.
Principal District and Sessions Judge Anju Bajaj Chandna ruled that the right to international travel is a constitutional right, and that Gupta’s temporary trip posed no significant risk to the ongoing investigation. The judge noted that Gupta’s anticipatory bail application is pending and he had previously been granted permission to travel abroad in a related case.
The ED, opposing the suspension, argued that Gupta’s departure could harm India’s economic interests and that he might not return. The agency alleges that Gupta and co-promoter Sanjay Dhingra created shell companies to inflate Kwality Ltd.’s turnover and siphon off loan funds. They are accused of using these funds to acquire assets for themselves and their families.
Despite the ED’s concerns, the court deemed the limited duration and purpose of Gupta’s trip sufficient to justify suspending the LOC. The temporary suspension will allow Gupta to travel to Singapore and return to India.
