**New Delhi, January 21, 2025** – The Supreme Court of India on Tuesday questioned the potential ramifications of barring individuals charged with heinous crimes like murder and rape from contesting elections. A bench comprising Justices Surya Kant and N. Kotiswar Singh raised concerns about the irreversible damage such a ban could inflict if the accused are later acquitted. The court acknowledged existing legal recourse if elected officials are subsequently found guilty of serious offenses.

The issue arose during an oral mentioning of a petition filed by advocate Ashwini Kumar Upadhyay, who argued that the right to contest elections is not a fundamental right. He questioned the need for a system where individuals with criminal charges are allowed to run for office. Justice Kant responded by questioning the number of individuals who actually step forward to contest elections.

The court’s deliberation touched upon a 2020 Supreme Court judgment mandating political parties to publicly disclose the criminal history of their candidates. This judgment, stemming from concerns about the increasing number of politicians facing serious charges, required parties to publish this information in newspapers and on social media, along with justifications for selecting candidates with criminal backgrounds. Failure to comply would result in contempt of court proceedings.
