**Madurai, January 21, 2025** – The Madurai Bench of the Madras High Court has levied a ₹10,000 fine on a petitioner from Thoothukudi district for filing a frivolous petition seeking the cancellation of land pattas (title deeds) issued to several individuals in Tiruchendur.

The petitioner, P. Ashok Kumar, claimed that private parties had encroached upon the land. However, the Division Bench, comprising Justices M.S. Ramesh and A.D. Maria Clete, dismissed the petition, stating that the petitioner’s claim was unsustainable. The court cited the presumption of truth and genuineness associated with entries in the Patta Passbook Act. The court further noted that if Mr. Kumar had grievances regarding the land pattas, the proper recourse would be to utilize the provisions of the Patta Passbook Act to amend the entries.

The court also criticized the petitioner for failing to include the private individuals as parties to the petition and for misrepresenting the case as a public interest litigation. The judges deemed the petitioner’s actions an abuse of the legal process and imposed the fine as an exemplary cost.
