**Chennai, January 21, 2025** – The Madras High Court has finally resolved a three-year legal battle, paving the way for the reconstitution of the Tamil Nadu Commission for the Protection of Child Rights (TNCPCR). The commission had been dormant since February 2022 when the State government prematurely dissolved it, leading to a protracted legal dispute.
The dispute stemmed from the government’s February 2022 order dissolving the commission, which had been formed in January 2021 for a three-year term. Psychologist Saranya T. Jayakumar, a member of the dissolved commission, challenged the government’s action, arguing that the dissolution was premature.
The case wound its way through the High Court, with various rulings and appeals. While a single judge initially quashed the government’s dissolution order, this decision was later stayed. The matter even reached the Supreme Court, which urged the High Court to expedite its decision.
Finally, a division bench of the High Court recently disposed of the case. The court acknowledged that the tenure of the 2021 commission had ended in January 2024, rendering the dispute technically moot. However, the court accepted the Advocate General’s assurance that Ms. Jayakumar’s service from January 2021 to January 2024 would be considered when the new commission is formed, and she will be eligible to apply for a position.
The Tamil Nadu government is expected to announce the formation of the new TNCPCR shortly.
