**New Delhi, January 20, 2025** – The Supreme Court adjourned until January 27th the hearing of a plea filed by a Bihar Police Superintendent of Police (SP) accusing an IPS officer of rape under false pretenses of marriage. The court requested amendments to the petition before resuming the hearing.
The SP, currently with the Patna CID, alleges that the Patna High Court wrongly quashed the FIR filed against IPS officer Pushkar Anand and his parents in December 2014. The FIR, lodged at the Mahila police station in Kaimur, charged Anand with rape and criminal intimidation, and his parents with abetting the crime.
The SP’s petition claims the High Court’s September 19, 2024, order was legally flawed and ignored the power imbalance between the SP (as a subordinate officer) and the then SP Anand. She alleges that Anand, leveraging his authority, initiated a relationship with her promising marriage, then reneged citing horoscope incompatibility.
The High Court, however, ruled that the consensual relationship, even if it ended poorly, didn’t constitute grounds for criminal charges. The Supreme Court’s adjournment allows for necessary corrections to the petition before a final decision is made.
