**NEW DELHI** – India’s Supreme Court has dismissed review petitions challenging its October 2023 decision refusing to legalize same-sex marriage. A five-judge bench, which included Justice P.S. Narasimha (the only remaining member of the original bench), reviewed the earlier judgment and found no errors. The court stated that the majority opinion in the October ruling was legally sound and warranted no intervention.
The review petitions were considered in chambers after the court declined to hold an open hearing. The bench carefully examined the judgments of former Justices Ravindra Bhat and Hima Kohli, along with the concurring opinion of Justice Narasimha. They determined that the ruling was consistent with existing law.
The current bench was formed after Chief Justice of India Sanjiv Khanna recused himself from the review process in July 2024. The original October 2023 ruling was delivered by a bench including then-Chief Justice D.Y. Chandrachud, Justices S.K. Kaul, Ravindra Bhat, Hima Kohli, and P.S. Narasimha, all but Justice Narasimha have since retired. This dismissal effectively ends the legal challenge to the Supreme Court’s stance on same-sex marriage, for now.
