**New Delhi:** The Supreme Court of India will examine whether it is necessary to hear the victim’s perspective before granting bail to accused in rape cases. This decision follows a hearing on a petition challenging a Kerala High Court order that cancelled the pre-arrest bail of a rape accused.
The Kerala High Court had revoked the bail, citing the failure to consider the victim’s statement. The accused then appealed to the Supreme Court, which has issued a notice and stayed the High Court’s order. While the High Court’s order noted the accused’s cooperation with the investigation, the Supreme Court will now consider the broader question of whether courts should mandatorily hear victims before granting bail in such sensitive cases. Arguments presented before the Supreme Court highlighted the High Court’s cancellation of bail as technically incorrect. The bench comprising Justices B.R. Gavai and K.V. Viswanathan will now determine the procedure moving forward.
