**Bengaluru, India (November 29, 2024)** – A copyright infringement lawsuit filed by South Indian actor Dhanush against his colleague Nayanthara has sparked debate over the misuse of copyright law in the film industry. The dispute centers on the use of footage from Dhanush’s 2015 film, “Naanum Rowdy Dhaan,” in Nayanthara’s upcoming Netflix biopic.

Nayanthara claims she requested permission to use the footage two years ago but received no response. Netflix subsequently used a short mobile phone clip captured by Nayanthara herself during the film’s production. Dhanush responded by initiating legal action.

Legal experts are divided on the case. Professor Arul George Scaria of the National Law School of India University, Bengaluru, argues that the situation highlights the potential for copyright law to be weaponized. He points out that while the producer typically holds the copyright to a film, this doesn’t encompass all elements. The key question is whether the used clip infringes on existing copyrights, considering that it appears to be behind-the-scenes footage rather than a direct reproduction of the film itself.

Professor Scaria further emphasizes the concept of “fair dealing” under Section 52 of the Indian Copyright Act, which allows for limited use of copyrighted material without infringement. He suggests that given the close connection between Nayanthara’s life and her films, the use of short clips could be considered fair use. However, the existence of contracts controlling behind-the-scenes footage must also be considered.

The case raises concerns about the potential for misuse of copyright law to stifle criticism or silence opponents. Professor Scaria urges courts to take a strong stance against such unjustified legal threats, particularly given the potential for criminal penalties in copyright infringement cases. The outcome will set a significant precedent for the Indian film industry’s use of copyrighted material in biographical films.
