**NEW DELHI, November 27, 2024** – The Delhi High Court will examine the adequacy of compensation awarded to rape survivors who contract HIV as a result of the assault. The case was brought by a woman who was raped in 2017 at the age of 15, resulting in her HIV infection. She received ₹2.75 lakh in interim compensation but argues this is insufficient to cover her ongoing medical expenses and lifelong challenges.

The woman, who was lured to Jaipur under false pretenses and subsequently assaulted by multiple individuals, contacted the Brave Souls Foundation for assistance after discovering her HIV status two years later. Her petition argues that current victim compensation schemes lack provisions for HIV infection contracted through sexual assault. She is seeking enhanced financial compensation, rehabilitation, access to education, and a government job.

Justice Sanjeev Narula issued a notice to the Delhi government to address the petitioner’s claims, noting the “unfortunate case” and the inadequacy of current compensation guidelines in addressing such situations. Shaheen Malik of the Brave Souls Foundation commented on the lack of a comprehensive government rehabilitation policy for such survivors.
