**Washington, D.C.** – A federal judge on Monday dismissed the election subversion case against President-elect Donald Trump, citing a long-standing Justice Department policy against prosecuting a sitting president. Judge Tanya Chutkan granted a motion by Special Counsel Jack Smith to dismiss the case without prejudice, meaning the charges could be reinstated after Trump leaves office.

The decision follows a similar move by Smith to drop his appeal of the dismissal of a separate case concerning the alleged mishandling of classified documents. That case, dismissed earlier this year by a Trump-appointed judge on procedural grounds, will continue against Trump’s co-defendants, Walt Nauta and Carlos De Oliveira.

The election subversion case accused Trump of conspiring to overturn the results of the 2020 presidential election. The Justice Department argued that while their position on the merits of the case remains unchanged, the Constitution prohibits the prosecution of a sitting president.

Trump celebrated the dismissals on Truth Social, claiming the cases were “empty and lawless” and a waste of taxpayer money. However, the dismissals do not affect two state-level cases against Trump: one in New York concerning falsifying business records, and another in Georgia related to election interference. The New York sentencing has been postponed pending a legal challenge, while the Georgia case is expected to be paused during his presidency.
