Tue Nov 12 19:43:29 UTC 2024: ## UN Court Greenlights Discrimination Cases Between Armenia and Azerbaijan

The International Court of Justice (ICJ) has ruled that it will proceed with hearing discrimination cases filed by Armenia and Azerbaijan, arch-rivals embroiled in a long-standing conflict over the Nagorno-Karabakh region.

The two countries, both signatories to the International Convention on the Elimination of All Forms of Racial Discrimination, filed counter-claims at the ICJ in 2021, accusing each other of ethnic cleansing, hate speech, and racist propaganda.

Following the 2020 war over Nagorno-Karabakh, Armenia alleges Azerbaijan violated the convention through its actions in the region. Azerbaijan denies these claims and counters that Armenia is the perpetrator.

In December 2021, the ICJ issued emergency orders, urging both sides to prevent incitement and promotion of racial hatred.

The court has since reviewed motions submitted by both parties, narrowing the scope of Azerbaijan’s case to incidents after September 1996 and excluding alleged environmental harm attributed to Armenia.

The latest developments follow Azerbaijan’s recent seizure of Nagorno-Karabakh, which prompted the flight of almost all ethnic Armenians from the region. The ICJ issued emergency measures ordering Azerbaijan to allow these refugees to return, a directive Azerbaijan claims it has already implemented.

While the ICJ’s rulings are legally binding, it lacks enforcement mechanisms. The court has not yet announced when the next hearings in the rival cases will be held, and a final decision on the merits of the cases could take years.
