**New Delhi, November 9, 2023** – As Chief Justice of India Dhananjaya Y Chandrachud prepares to retire on Sunday, he has expressed concern about the perception surrounding retired judges accepting roles in various tribunals and grievance redressal bodies.
In an interview with Hindustan Times, Chandrachud emphasized that even after leaving office, former judges are often looked upon as continuing to hold the weight of their former positions. He stated that his personal belief is that even after retiring, he should continue to uphold the standards expected of a judge or Chief Justice.
Chandrachud highlighted the importance of these tribunals, such as the National Green Tribunal and National Consumer Disputes Redressal Commission, in resolving disputes related to complex legal and economic scenarios. He stressed that these positions demand individuals with the highest level of integrity and expertise, making retired Supreme Court and High Court judges ideal candidates.
However, he also acknowledged the potential for negative perceptions, with the public sometimes viewing such appointments as quid pro quo for past rulings. This apprehension, according to Chandrachud, can discourage many judges from accepting these roles, hindering the development of the nation’s economy.
“We need former judges in these positions to ensure that the process is fair and trustworthy,” Chandrachud said, advocating for a more positive portrayal of retired judges taking on such roles. He stressed that the authority of Parliament’s decision to appoint retired judges to these positions shouldn’t result in scrutiny or criticism of the individual.
Chandrachud’s comments come ahead of his retirement, as he prepares to be succeeded by Justice Sanjiv Khanna on Monday. He concluded his final working day by delivering a farewell speech, seeking forgiveness for any unintentional hurt he may have caused during his tenure and expressing gratitude to the Supreme Court and its members.
