**Sacramento, CA** – The future of rent control in California hangs in the balance as voters prepare to decide on Proposition 33, which would repeal a state law limiting local governments’ ability to regulate rent increases.
If passed, the proposition could bring sweeping changes to cities like Berkeley, where existing ordinances already allow for more stringent rent control than currently permitted by state law. This could result in immediate rent caps on single-family homes and apartments over 20 years old, benefiting tenants while potentially creating headaches for landlords.
“Families who are living in units that aren’t right for them will have a chance to move without losing their affordability,” said Leah Simon-Weisberg, a tenant lawyer and chair of Berkeley’s rent board.
However, critics argue that such expanded rent control would stifle new housing construction and revert the state back to a pre-1995 era of stricter regulations, potentially harming both landlords and tenants in the long run.
“We would revert back to the 1980s and it wouldn’t just be roller skates or rainbow headbands, it would be a lot worse,” said Krista Gulbransen of the Berkeley Property Owners Association.
Cities like San Francisco and Los Angeles have already signaled their intent to expand rent control if Prop. 33 passes, with San Francisco even enacting legislation to bring an estimated 16,000 additional units under rent control.
“It’s completely arbitrary that we can create rent control for buildings from 1978 but we can’t do it for 1980,” said Los Angeles City Council member Hugo Soto-Martínez.
Meanwhile, landlords are expressing concern over the potential impact on their businesses, citing rising costs and the need for flexibility in setting rent rates.
“There is a real possibility that Proposition 33 will pass because of the widespread belief that the rents are too damn high,” warned real estate firm Bornstein Law in an email to clients.
The debate surrounding Prop. 33 highlights the complex challenges facing California in balancing the needs of renters and landlords amidst a severe housing crisis. The outcome of this election could have a significant impact on the state’s housing landscape for years to come.
