Sat Nov 02 16:41:03 UTC 2024: ## Telangana High Court Upholds Further Investigation in Fatal Road Accident Case Involving Son of Former BRS MLA
**Hyderabad, November 2, 2024:** The Telangana High Court has dismissed a writ petition filed by Mohammad Raheel Aamir, son of former BRS MLA Shakeel, challenging a trial court order that permitted further investigation into a fatal road accident. Aamir is the prime accused in the case.
Justice K. Sujana of the High Court ruled that there were “no illegalities or infirmities” in the order issued by the VXII Additional Chief Metropolitan Magistrate of Nampally, which allowed the prosecution to proceed with further investigation.
The case stems from a December 2023 incident where a speeding car crashed into a barricade outside the then Telangana Chief Minister’s residence. Initially, a man named Abdul Asif was arrested for the accident, but police later discovered that Aamir was the actual driver. Aamir allegedly fled the country shortly after the incident.
The Punjagutta police station Inspector, B. Durga Rao, was subsequently suspended for allegedly assisting Aamir in covering up the accident.
Further investigation by the West zone police revealed that Aamir was also involved in a separate fatal road accident in 2022. In that incident, Aamir allegedly rammed his car into a woman carrying her toddler son, resulting in the child’s death.
The West zone police filed a petition seeking permission to conduct further investigation into the 2022 incident. The court granted their request, leading Aamir to file the writ petition in the High Court.
Justice Sujana, in her verdict, upheld the lower court’s decision, stating that under the Criminal Procedure Code, magistrates are empowered to order both initial and further investigations. The judge also noted that the filing of a charge sheet does not preclude the police from conducting further investigation.
This ruling effectively clears the way for the police to continue their investigation into both accidents involving Mohammad Raheel Aamir.
