A Las Vegas father and his 18-year-old daughter are suing the doctors who performed their IVF treatment after a DNA test revealed they are not biologically related. The lawsuit, filed on Monday, alleges that the clinic mixed up fertilized embryos, leading to a devastating discovery for the family.
The teen, who took an Ancestry DNA test in October 2023, learned that the man she had always believed to be her father was not. Both the father and daughter, who are remaining anonymous, are reported to be suffering from “extreme and severe emotional upset” as a result of the revelation.
The lawsuit claims that the father, whose wife passed away in 2006, was under the impression that his daughter was born from a donor embryo fertilized with his sperm. Now, he faces the agonizing uncertainty of not knowing what happened to the embryo created with his sperm and whether he has another child he is unaware of.
The lawsuit targets Dr. Rachel McConnell, who led the now-closed Nevada Fertility C.A.R.E.S. clinic, and embryologist Dee Harris. It alleges that their reckless actions deprived the father of his planned biological connection with his daughter.
The father is now pursuing legal adoption of his daughter, a process that will incur significant financial expenses. The lawsuit seeks damages from the defendants, claiming their actions were “reckless and outrageous” and demonstrate “a conscious disregard for the rights and safety of others.”
Murdock and Associates, representing the father and daughter, believe that the IVF clinic failed to follow proper protocols, leading to this devastating mix-up. The firm claims that “the meticulous protocols that should have been followed were not.”
Attempts to reach McConnell and Harris for comment have been unsuccessful. Notably, Harris’ information and photo have been removed from her current employer’s website.
