**Seremban, Sept 25:** A Sessions Court has awarded over RM223,000 in damages to a mother and daughter who were attacked by two Rottweilers in Seremban in 2019. The court found the dog owner negligent and liable for the injuries sustained by the victims.
Lim Chwee Tin, a 36-year-old beautician and aesthetic consultant, and her seven-year-old daughter were walking past the defendant’s house in Kepayang Heights when they were attacked. The incident occurred on April 27, 2019.
Judge Surita Budin, in her written judgment, awarded the plaintiffs RM95,000 in general damages, RM36,469.60 for special damages, and RM88,000 for loss of income.
The court heard that one Rottweiler initially attacked the daughter, and the mother tried to shield her child. However, the dog bit the mother’s hand. When the owner emerged from her house, the second Rottweiler attacked the mother, biting her left palm.
The court found that the defendant, the owner of the dogs, was negligent in her duty of care. The defendant’s claim that the victims provoked the dogs was dismissed, as the court concluded that the dogs were not properly controlled and cared for.
Judge Surita also emphasized the Rottweiler breed’s reputation for aggression and pointed out that the defendant had previously admitted to her dogs attacking and killing a neighbor’s dog. She also noted that the defendant failed to obtain a dog license until after the incident and that the dogs were not vaccinated on the day of the attack.
The defendant has since filed an appeal to the High Court.
