**KLANG** – The High Court has rejected a request for a second psychiatric evaluation of a man accused of murdering his mother in Kuala Selangor two years ago.
Mohamed Azam Abdul Rasib, 31, was initially deemed mentally fit following a psychiatric examination, but his lawyer, Ahmad Ishrakh Saad, argued that the accused was not satisfied with the findings and requested a second evaluation.
However, Judge Norliza Othman dismissed the application on Wednesday, Sept. 25, citing the late timing of the request and the already scheduled trial dates for October and November.
“There should not be two conflicting reports,” said Judge Othman. “You can subpoena the doctor or issue a notice to summon the doctor, and you can cross-examine him.”
The judge also stated that delaying the trial would push it into 2028, a scenario she was unwilling to accept.
Azam is accused of murdering his mother, Hamidah Ismail, 56, at their home in Pasir Penambang on Jan 15, 2022. He faces a charge of murder under Section 302 of the Penal Code, which carries the death penalty upon conviction.
The trial is scheduled to begin on Oct 28 and continue until Nov 8. Azam’s lawyer has been advised to address any remaining concerns about the initial psychiatric reports during the trial itself.
