Surrey County Council is facing a hefty bill of over £70,000 following a landmark legal challenge over its approval of oil well expansion at the Horse Hill site in Horley. The council will be responsible for the appellant’s costs at both the High Court and Court of Appeal, capped at £35,000 each. The cost of taking the case to the Supreme Court is yet to be confirmed.
The case was brought by Sarah Finch, representing the Weald Action Group, who argued that the council failed to adequately consider the downstream emissions associated with the oil well expansion. While the Supreme Court did not force the council to reject the proposal, it did overturn the planning permission on the grounds of insufficient consideration of environmental impact.
The decision, described as a landmark by supporters, has raised questions about future oil and gas projects in the UK. Stephen Sanderson, CEO of UK Oil and Gas PLC, the company behind the Horse Hill project, expressed perplexity at the Supreme Court’s ruling.
Councilors will discuss the implications of the case at a planning and regulatory meeting on Wednesday. The council had initially approved the expansion in 2019, believing they had followed proper planning procedures. While some residents express disappointment over the loss of potential job prospects, others applaud the decision to prioritize environmental protection.
