**Thiruvananthapuram, Kerala:** Malayalam actor Siddique was denied anticipatory bail in a rape case by the Kerala High Court, after his lawyer attempted to discredit the survivor by using her social media posts. The court deemed this tactic “unwarranted and uncharitable,” highlighting the disturbing trend of shaming complainants in sexual assault cases.
Siddique’s lawyer, Raman Pillai, submitted 17 annexures, 12 of which were Facebook posts by the survivor. The court, however, found that many of these posts were unrelated to the case, including social commentary and personal venting.
The actor’s defense claimed the posts contradicted the survivor’s portrayal of herself as “a vulnerable, middle-class, single daughter,” arguing that her social media activity showed a lack of fear and trauma. This was further reinforced by citing instances of her public criticisms of industry figures.
The survivor, however, detailed the alleged assault in her complaint, stating that Siddique befriended her online in 2014 and later invited her to his hotel room for a casting discussion, where the alleged rape occurred.
The court’s decision marks a significant setback for the actor, who faces serious allegations. It also serves as a strong message against the prevalent tactic of shaming and silencing survivors in sexual assault cases.
