However, the Appellate Division sided with HJSC, ruling that the letter agreement released them from all liability except for their warranty obligations.
Furthermore, the court dismissed Seatrium’s argument that HJSC remained liable under its warranty obligations due to a lack of express notice requirements. The Appellate Division clarified that HJSC’s warranty obligations only covered defects that manifested or were discovered during the warranty period.
