**Jaipur, India** – The Rajasthan High Court has ruled that the redistribution of marks for deleted exam questions within the same subject is a fair and impartial method, dismissing a petition that challenged the practice.
The petition, filed by candidates for the Junior Accountant and Tehsil Revenue Accountant positions, argued that the Rajasthan Staff Selection Board (RSSB) should either disregard the deleted questions or award bonus marks to all candidates. They claimed that redistributing marks within the subject disadvantaged them.
However, the court, led by Justice Vinit Kumar Mathur, sided with the RSSB, stating that the method maintained parity among candidates and preserved the exam’s structure. The court cited previous cases where similar methods were upheld, emphasizing that distributing marks subject-wise ensured fairness and prevented altering the weightage of other subjects.
The court reasoned that deleting questions and redistributing marks within the same subject ensured candidates were assessed based on their knowledge of that particular subject. The court stated that this system ensured fairness as candidates were not penalized for the deletion of questions, thus eliminating any discrimination.
The court further emphasized that “if the procedure adopted by the respondents is fair and impartial and because of that even if some candidates are adversely affected, the court may refrain from intervening for the larger benefit of the candidates, who have participated in the selection process.”
