**Detroit, MI** – Alternate Solutions Health Network, LLC (ASHN), a provider of home health care services, has agreed to pay $65,000 and implement other measures to settle a disability discrimination lawsuit filed by the U.S. Equal Opportunity Commission (EEOC).
The lawsuit alleged that ASHN violated the Americans with Disabilities Act (ADA) by firing a former employee who requested a reasonable accommodation after being diagnosed with a brain tumor and seizure disorder. The employee, who worked as an in-home occupational therapist, sought permission to use a ridesharing service for transportation to patient homes.
ASHN’s denial of the request and subsequent termination of the employee prompted the EEOC to file suit. The case has now been resolved through a two-and-a-half-year consent decree.
In addition to the monetary damages, ASHN will also undertake the following:
* Provide training for human resources and management employees on ADA compliance.
* Develop a formal policy on reasonable accommodations, including examples of potential accommodations.
* Submit annual reports detailing all reasonable accommodation requests.
This settlement underscores the importance of employers providing reasonable accommodations to disabled employees, as mandated by the ADA. The EEOC continues to actively investigate and pursue legal action against employers who fail to comply with the law.
