**Colorado, USA** – A US Federal Judge has dismissed a class-action lawsuit filed against Atomic Wallet, a non-custodial decentralized cryptocurrency wallet, over a $100 million hack that occurred in June 2023. The dismissal was granted due to a lack of jurisdiction over the Estonian-based company.
The lawsuit, filed by a group of Atomic Wallet users in August 2023, alleged that the company failed to adequately protect user funds and was liable for the losses incurred during the hack. The plaintiffs claimed that Atomic Wallet had a connection to Colorado based on its advertising on the X platform, its mobile app availability in the state, and the fact that one of the plaintiffs frequently interacted with Atomic Wallet’s customer service from Colorado.
However, the judge, Philip Brimmer, ruled that these connections were insufficient to establish jurisdiction over the company. He argued that Atomic Wallet’s software products, unlike physical goods, can be accessed by users anywhere in the world without the company’s direct knowledge or control.
While the lawsuit was dismissed against Atomic Wallet, its CEO Konstantin Gladyshev, and its software development company, Evercode Infinite, the judge granted a 21-day extension to the plaintiffs to strengthen their arguments against Ilia Brusov, a co-founder of Evercode Infinite and a shareholder in Atomic Wallet.
The dismissal of the lawsuit represents a victory for Atomic Wallet, which has maintained its innocence and argued that the hack was a result of external malicious actors.
